Executive order on the lay-out of trailers and similar entities

In accordance with Sections 35, 43 and 84 of the Working Environment Act, cf. Order No.646 of 18 December 1985, as amended by Act No. 220 of 22 April 1987, Act No. 380 of 13 June 1990, Act No. 273 of 8 May 1991, Act No. 373 of 20 May 1992 and Act No. 474 of 24 June 1992, and by authority according to Section 73 of the Act, the following shall apply: 

Chapter 1 - Scope and General provisions

Section 1. Where comfort facilities are to be established in trailers or similar structures (hereafter, trailers) in accordance with the regulations for the layout of the workplace and which are transportable either as whole units or in modules, the interior layout of these must comply with the requirements in this Order, unless otherwise stated.

Section 2. Persons transferring, renting, passing on or displaying trailers as forms of shelter must ensure that when such structures are delivered for use or displayed, their layout and size correspond to the requirements of this Order. 

Chapter 2. Interior layout

Toilet

Section 3. Toilets must have a floor area of at least 1 m² and have a ventilator hatch of at least 100 cm². There must be one toilet for every 15 persons
 
Subsection 2. The toilet must be flushable and be connectable to the sewer system.
 
Subsection 3. The provisions of Subsection 2 do not apply to trailers to be used in circumstances which, in accordance with the rules for the layout of the workplace, do not require connection to a sewer. However, the toilet must have the same hygienic standards as a flush toilet

Dining facilities

Section 4. The eating space must have a floor area of at least 1 m² per person using it simultaneously, including an additional 1 m² of the total floor area.
 
Subsection 2. The eating space must be separate. Food and drink must be stored in a responsible manner, if possible in a refrigerator and there must be the possibility to heat food and boil water for tea or coffee.
 
Subsection 3. The room must have at least 2 ventilation hatches of at least 100 cm² each.
 
Subsection 4. The eating space must have a window area which is at least 10% of the floor area. It must be possible to open at least one window
 
Subsection 5. Windows must have some form of sun screen, e.g. curtains.

Changing, washing and showering facilities

Section 5. The changing room floor area must be of at least 1 m² per person in addition to the statutory requirements for washing and shower facilities in accordance with Section 4.
 
Subsection 2. The room must have at least 2 ventilation hatches of at least 100 cm² each.
 
Subsection 3. The room must be laid out and equipped in accordance with the following:

1. Personal clothes and work clothes must be kept separately, either in two cupboards for each person or in one vertically divided cupboard. The interior measurements of the cupboards must be at least 25 cm x 50 cm x 170 cm.
2. The measurements of divided cupboards must be at least 50 cm x 50 cm x 170 cm.
3. The cupboards must have locks and be fitted with shelves.
4. The cupboards must have external ventilation, through e.g. common air vent.
5. There must be a bench by the cupboards.
6. It should be possible to dry work clothes either in the cupboards or on a common hanger.

Subsection 4. There must be a direct access from the changing room to the washing and shower facilities, which must meet the following requirements:

1. The sinks must be supplied with hot and cold running water. A maximum of 5 persons per sink. Instead of a sink, a washing trough may be installed with at least one mixer tap for every five persons. The floor area around each sink or mixer tap must be at least 1 m².
2. Showers must be supplied with hot and cold running water. At most 10 persons per shower. The floor area of each shower, including installation must be at least 1 m². It must be possible for the circulation of air in the shower room, as far as possible via mechanical ventilation.
3. Insulation

Section 6. The outer walls must be insulated with material comparable to 75 mm mineral wool with a lambda value of 0.039 W/m  °C.
 
Subsection 2. Ceilings and floors must be insulated with material comparable to 100 mm mineral wool with a lambda value of 0.039 W/m °C.
 
Subsection 3. Windows must have two layers of glass or similar, or be double glazed.

Internal walls and floor covering

Section 7. Internal walls and floor coverings must be of easily washable materials.

Ceiling height

Section 8. The height of the room must be at least 2.10 m. In larger structures (pavilions), the height must be at least 2.30 m.

Lighting

Section 9. There must be artificial lighting of at least 200 lux per 85 cm floor area.

Heating

Section 10. It must be possible to heat the rooms to at least 18 °C.

Chapter 3 - Dispensations and complaints

Section 11. The Director-General of the Danish Working Environment Authority may allow deviations from the provisions of this Order under circumstances which are deemed reasonable and proper.

Section 12. Decisions made by the Danish Working Environment Authority under this order are subject to appeal according to Section 81 of the Health and Safety at Work Act.

Chapter 4 - Penalties

Section 13. Unless a higher penalty is prescribed under the Danish Working Environment Act or other legislation, imprisonment or fine will be the penalty incurred by any person who

1. fails to comply with Sections 2-10
2.  fails to comply with the requirements in accordance with the Order, or
3. disregards the conditions for dispensation according to the Order.

Section 14. In the event of a breach is committed by a public limited company, a general partnership or a private limited company, the company shall be held liable for the payment of a fine. Any breach committed by the state, a municipality or municipal body subject to Section 60 of the Act on Municipal Management, will be subject to payment by fine.

Chapter 5 - Entry in force etc.

Section 15. The Order shall go into effect on 1 October 1992.

Subsection 2. Trailers that were in use prior to 1 February 1990 which comply with the Ministry of the Interior and Social Affairs Order No. 165 of 26 April 1960 on the regulation on shelters on building and construction sites may continue to be rented out and used until 1 February 1995.
