Fines for breaches of the Danish Working Environment Act for employers

An employer may be fined for breaches of the Danish Working Environment Act. The fine is determined on the basis of whether the breach is associated with a health and safety hazard. Here you can find more information about the different types of fines and how Arbejdstilsynet (the Danish Working Environment Authority) calculates the amount of a fine.

Fine for a breach that does not pose a direct risk to health and safety (formal breach)

A formal breach is a breach that is not directly associated with a health and safety hazard, for example a failure to carry out a workplace risk assessment (APV).

As a general rule, a fine imposed on an employer for a formal breach of working environment legislation is fixed at DKK 10,000, regardless of the size of the company.

However, where a company has 35 or more employees, the fine may be as much as DKK 50,000 if the employer fails to report a work accident to Arbejdstilsynet.

The table below shows the fine levels applicable from 1 March 2026 for employers’ formal breaches of working environment legislation based on the size of the company.

Fine for a breach posing a direct risk to health or safety (material breach)

A material breach is a breach that poses a direct risk to health or safety. Examples include welding without the use of extraction equipment or working at height without protection against falls. 

A fine imposed on an employer for a material breach will normally consist of several elements. First, Arbejdstilsynet determines a basic fine, which may then be increased depending on the circumstances of the breach.

The basic fine for material breaches is DKK 36,900 or DKK 66,900, depending on the seriousness of the breach.

For most material breaches, the basic fine is DKK 36,900.

Under working environment legislation, a material breach for which the basic fine is DKK 66,900 is characterised by a degree of seriousness such that the risk of injury to life or health, or the potential consequences of the breach, is generally greater than for ordinary material breaches. Examples include demolition work carried out without the proper safety equipment, excavation work without adequate protection against ground collapse and work involving a risk of explosion, suffocation, poisoning or chemical burns.

The different stages used in calculating fines for employers' material breaches of working environment legislation are set out below. Most breaches will be of such a nature that it will be relevant to take several stages into account when calculating the fine, although it will rarely be necessary to apply all stages in the calculation.
