At Arbejdstilsynet (the Danish Working Environment Authority), we process, store and disclose your personal data in accordance with applicable rules and recommendations.

The Danish Working Environment Authority takes good care of your personal data 

In connection with a supervisory visit, the Danish Working Environment Authority has recorded personal data about you. As a government authority, we are obliged to inform you of this in accordance with the rules on data protection.

This duty is covered by Articles 13 and 14 of the General Data Protection Regulation.

Why have we recorded data about you?

We process your personal data as part of our work as the Danish authority responsible for working environment. When we collect personal data about you, we do so in order to assess whether the working environment at your workplace is safe and healthy, both physically and mentally. The tasks of the Danish Working Environment Authority are set out in Section 72(1) of the Danish Working Environment Act.

What categories of data have we recorded about you and on what legal basis?

We will generally process the following data about you, to the extent necessary for the processing of your case:

  • General personal data, including your name and possibly also your job title, are processed pursuant to Article 6(1)(e) of the General Data Protection Regulation.
  • Special categories of personal data, such as data concerning health in cases where the inspection visit concerns the investigation of an occupational accident, are processed pursuant to Article 9(2)(b), (f) and (g) of the General Data Protection Regulation, cf. Section 7(2) and (4) of the Danish Data Protection Act.
  • Confidential personal information in the form of your personal ID number is processed pursuant to Article 87 of the General Data Protection Regulation and Section 11 of the Danish Data Protection Act.
  • Information about criminal offences that is necessary for the performance of the Danish Working Environment Authority's tasks is processed pursuant to Article 10 of the General Data Protection Regulation and Section 8(1) and (2)(3) of the Danish Data Protection Act.

How do we store your personal data?

We only store your personal data for as long as we need them or have an obligation to retain them. We store your information securely and confidentially in our IT systems, to which access is controlled and limited to those employees who need the information for their work.

Information about you in the Danish Working Environment Authority's electronic case and document management system will be transferred for storage in the Danish National Archives after the closure of your case and the related record period. This takes place in accordance with the rules of the archive legislation.

Who receives your personal data?

We entrust your personal data to our data processors who assist with the operation and administration of our IT systems.

It may be necessary for us to disclose your information to one or more authorities, such as:

  • The police (for example, in the event of criminal cases concerning violation of the Danish Working Environment Act or the Danish Posting of Employees Act).
  • The tax authorities (for example, when checking registration and tax details in connection with working environment cases).
  • The Council of Appeal on Health and Safety at Work (in the event that a ruling made by the Authority is appealed).
  • Others for use in statistical or scientific studies of substantial societal importance, for which processing is necessary to the performance of such studies.

As a general rule, your personal data are confidential, but in certain cases we may be required to disclose the information, for example in connection with a request for access to documents.

Your rights

The General Data Protection Regulation grants you several rights in relation to our processing of your personal data. 

Should you wish to exercise any of these rights, please contact us. 

You have the right to:

  • Access – you have the right to know what data we store about you, along with other relevant details concerning your personal data.
  • Rectification – you have the right to apply for the rectification of information that is incorrect or misleading.
  • Restriction – in certain cases, you have the right to have the processing of your personal data restricted.
  • Erasure – in certain cases, you have the right to have personal data, which we process about you, deleted.
  • Objection – In certain cases, you have the right to object to our otherwise lawful processing of your personal data. However, under the applicable rules on data protection, a number of exceptions to these rights apply.

You can complain about the processing of your personal data

You can complain to the Danish Working Environment Authority if you are dissatisfied with our processing of your personal data.
