You can complain to Arbejdstilsynet, the Danish Working Environment Authority, if you suspect that the working environment regulations are being violated. This applies whether you yourself work at the company or whether it concerns the working environment of others.
You can also complain if you suspect that a foreign company carrying out work in Denmark is violating the working environment regulations.
It’s your decision whether to complain anonymously or not
Arbejdstilsynet will treat your complaint with full confidentiality unless you yourself choose to give digital consent to waive the Arbejdstilsynet’s duty of confidentiality regarding the complaint. In other words, it is up to you whether you wish to complain anonymously or not.
Why consider giving consent?
Under the Danish Working Environment Act, Arbejdstilsynet has a special duty of confidentiality, which means that Arbejdstilsynet may not inform the employer or others that it has received a complaint about the working environment, unless the complainant has given consent.
By giving consent, you provide Arbejdstilsynet with better opportunities to respond to the health and safety issue you are complaining about. This is because, during the inspection visit, Arbejdstilsynet can actively use the information in your complaint as part of clarifying and documenting a possible breach of the working environment regulations, when Arbejdstilsynet is permitted to pass on information about the complaint.
Whether you complain anonymously or provide consent, your complaint about the working environment is important for Arbejdstilsynet to effectively supervise the working environment at your own or others’ workplaces.
What does giving consent mean for you?
When you give consent, you authorise Arbejdstilsynet to pass on information about your complaint to the employer and others. Arbejdstilsynet may disclose that it has received a complaint, who submitted it, the content of the complaint and that the Authority will conduct an inspection visit based on the complaint.
Can you give consent on behalf of others?
No, only the complainant themselves has the right to give consent to waive Arbejdstilsynet’s duty of confidentiality regarding a complaint about the working environment This means that you cannot lift the confidentiality of a complaint on behalf of another person. If the complainant wishes to give consent, they must themselves complete the digital complaint and consent form.
